Fees for Services: With this Terms of Use, you agree to pay to Survey360 any fees for each service you are purchasing, in addition to the price and payment terms mentioned with the service. The fees will be billed and accounted. Fees paid by you are non-refundable, except as provided in these Terms.

Subscriptions: Some of our services are based on subscription basis, that means that you can be billed in advance on a recurring, periodic basis i.e. a particular billing cycle. Billing cycle is basically on annual or monthly basis. Your subscription will be automatically renewed at the end of the billing cycle unless you yourself cancel the auto-renewal process, you can find auto-renewal process through your online account management page, or you can contact our customer support team.

Taxes: You have to pay tax to Survey360 for services without any reduction in price. The valid tax exemption certificate authorized by the appropriate taxing authority or documentation providing evidence that no tax should be charged has to be shown to the company. If you are required by law to withhold any taxes from your payments to Survey360, you must provide an official tax receipt or other appropriate documentation to support such payments.

Change in Price: The fees charged for any service at any time may vary on the basis of the subscription and the services. Survery360 will provide you with reasonable prior written notice of any change in fees to give you an opportunity to cancel the subscription before it is valid.

Overage Fees: Unless stated, any kind of overage fees will be incurred by you in the bill. Overage fees which remain unpaid for 30 days after being billed will be considered to be overdue and will be charged in addition with the next bill. Failure to pay will result in suspended or terminated account.

Privacy: you may submit content to Survery360 or third parties may submit content to you through our services. The privacy of the content will be maintained and also service specific data, user policies, privacy statements and privacy notices will be kept private.

Confidentiality: The information provided by the end user will be confidential with us. The content is not regarded as confidential information incase a) content is public b.) content was lawfully known to Survey360 before receiving it from you c.) if third party receives without knowledge of Survey360 d.) content was independently developed by Survey360 without reference to your content. Survery360 may disclose your content for any law or legal process.

Security: Sruvey360 will store and process your content in a manner consistent with the industry security standards. We have implemented appropriate admin, technical and organizational policies and ensure the security and integrity of your content.

Ownership and License: You retain ownership of all your intellectual property rights in your content. We don’t claim ownership over any of your content. We also give royalty-free license to use and reproduce, distribute, modify, adapt, create derivative works and make publicly available. The license also extends to any trusted third party. We may also use your feedback without any permission and obligation to you.

Copyright and other Claims: If you believe that your work has been exploited in any way, you may notify our agents for claims of copyright infringement. We respond to notices of alleged copyright infringement in accordance with DMCA, Digital Millennium Copyright Act. We also respect the intellectual property rights of others; we believe to do the same from our users. If you believe Survey360 user is infringing upon your rights, you can report through our online form.

Neither any of the terms grant you ownership in the services or the content you access on our website. We don’t grant any right to use Survey360 trademarks, content or other brand elements.

Third-Party Content and Resources: The services display content, services provided by others is not owned by Survey360. Such contents are the sole responsibility of the third-party. In relation to the same, we are not responsible for the rights and permissions provided by the third party. We also do not use any content from the services which you have got the permission of its owner or legally authorized to do.

Survey360 may publish links on our website maintained by the third party. We don’t represent any legal obligation of the third party.

Content Review: Any content violating the Terms will be considered unlawful and will be deleted or refused by our owner or managing authority.

Secured Password: We are responsible for safeguarding the passwords and other details which are asked while registering the account with Survey360. We are fully authorized to stop any unlawful activity. If you become aware of any unauthorized access to your account, it is your responsibility to notify Survey360 instantly so that we can hold the activity and prevent the loss.

Accurate Details: We send notices to email address registered with your account. You must keep your email address, contact details and payment details accurate and up-to- date. Accounts are controlled by the admin and authorized entities.

Backups: Solely you are responsible for taking care of your content. Maintaining, protecting, backups and development of the content are done at your end. We are not liable to pay for any failure or loss of your data, content.

Account Inactivity: may terminate your account or delete in any case of unlawful activity or no account activity. We may also do the above act in case of no or late payment. We send a warning email before terminating your account. Once deleted you have to further register and do the start from the beginning.

Customer Success Manager (CSM): We may assign you customer success manager to help you more effectively and give assistance.

Legal Status: Our services are intended for use of individuals above 14 years of age. If you are under 14, we do not give power to form contract with you, you have to have supervision of your adults.

Legal Compliance and Responsibilities: You can use our services within the applicable law and also you must comply with the requirements while using our services:

You must not buy our services for any competitive use.

You may not misuse our services or attempting to access them using method other than given interface for communication and accessing the services.

You must not attempt to misuse our services, after the termination of the account due to any Terms violation.

Unless any written authorization by Survey360 is given, you may not use any other means to extract the data from our website.

You may not transmit any malware, virus or any other malicious software or links on our website.

You may not engage in any excessive usage of the service given at Survey360 and also you may not infringe the intellectual property rights or commit any unlawful activity.

Unless authorized from Survey360 you are not authorized to resell or lease the services given Survey360.

By Survey360: We can terminate your account at any time if found any illegal activity noticed. We can also terminate the Subscription in the middle of the billing cycle due to breach of the Terms, as mentioned in the Terms. If you fail to pay the fees for 30 days past due date, the account will be suspended. No refund will be provided for the above cases.

By You: If you are found breaching these Terms, Survey360 will stop the Services including blocking the IP address.

Survey360 may change the Terms at any time for any reason that reflects the updates and versions. If any materialistic amendment is done, the change will notify to you by email. The changes may reflect sooner or later on the day. If you are not willing to agree the changes made to the Terms of the Service, you should stop using that service, or if continuing the same services, you automatically agree to be bound by the updates taken out.

The changes in the services will constantly change so as to improve and give best. Survey360 may add, remove or alter any functionality which we think is better suited. Survey360 may also limit, suspend or discontinue any service at this discretion. We may remove the service at any time with our sole discretion.

We keep our all online services up and checked but at time due to various reasons they may be unavailable.

WE DO NOT MAKE ANY KIND OF WARRANTIES, NON INFRINGEMENT OR ANY REPRESENTATIONS REGARDING AVAILABILITY, RELIABILITY OR ACCURACY OF THE SERVICES. SURVEY360, ITS AFFILIATES, OFFICERS, AGENTS, SUPPLIERS, EMPLOYEES OR LICENSORS WILL NOT BE LIABLE FOR ANY CONSEQUENTIAL ACT, LOSS OF THE DATA, BUSINESS, REVENUES OR PROFITS OR ANY OTHER LOSS. THE AMOUNT PAID BY YOU TO SURVEY360 FOR THE USE OF THE SERVICES DURING THE 12MONTHS PERIOD MAY LEAD TO THE EVENTS GIVING RISE TO THE LIABILITY AND FEES PAID FOR THE SERVICES.

Consumers: the laws and terms governed by the company Survey360 would not be overridden by any contract or waived by any consumers.

Business: If you are a business entity, you will hold harmless reflection towards Survey360 and its affiliates, agents, employees from any and all liabilities, damages and costs or loss.

You are contracting with Survey360. “We, Us, Our” are in reference to Survey360 and its attributes. Terms governing by the laws of United States of America are followed.

Assignments: We may assign and change the Terms at any time without any prior notice or intimation to you.

The Terms between you and Survey360 are agreements in written and oral concerning to subject of the matter. Any terms and conditions appearing during the purchase or any similar time issued by you do not apply to the services and are not override during any time, and are declared void.

Relationship between you and Survey360 is independent of the contractors and legal partners, agents or any employee.

Due to any failure or delay enforces at any time is not a waiver of the rights.

There is no third party beneficiaries to the terms listed.
